So, on a day when a lawsuit brought against the Obama administration by a branch of the Republican Party succeeds in overturning restrictions against gays serving openly in the military, the Obama adminstration brings a lawsuit of its own, one intended to protect the Defense of Marriage Act, so that they won't have to pay government benefits to same-sex spouses.

The reason for the lawsuit protecting DoMA is because it's required. The federal government must defend the law, regardless of the administration's opinions on that law.

It is expected that an appeal be brought against the Republican lawsuit as well, though if done so it should allow a timely repeal of the law at the same time, rendering both suit and appeal nullified.
