One principle that's normally applied, and which isn't being followed here, is reciprocity - a marriage valid in one US state is valid in all of the US; similarly, a heterosexual marriage from another country is considered valid within the US. The INS does not, however, recognise any same-sex partnerships, howsoever legal in the home country.
